The portal, www.Hardware 24x7.com(“Website”) and the mobile application ‘Hardware 24x7’ (“App”) (collectively “Platforms”) is managed and operated by Potential Wholesale Hardware Private Limited (“Hardware 24x7” or “We”), a private limited company incorporated under the Companies Act, 2013 with its registered office located at B-237, Road No. 6D, VKI area Jaipur, Rajasthan 302013, India. Hardware 24x7 is inter alia engaged in the business of wholesale and retail trade in Home Building Product sector and sale of their allied and auxiliary products (“Products”), through brick and mortar stores and through its Platforms.

TERMS AND CONDITIONS FOR USE OF THE PLATFORMS

The terms and conditions for use (“Terms of Use”) along with the applicable policies which are incorporated herein by reference constitute a legally binding agreement between You and Hardware 24x7, in connection with the access to or use of the Platforms. You are requested to read these Terms of Use carefully before accessing or using the Platforms.

Hardware 24x7 may update, modify, amend or change these Terms of Use (including any portion thereof) at any time, with or without any prior notice. It is Your responsibility to periodically review these Terms of Use for any update and changes and Your continued use of the Platforms will be considered as Your deemed acceptance to such updates and changes.

Accessing, browsing or otherwise using the Platforms will be construed as Your unequivocal and irrevocable acceptance and acknowledgement to the terms and conditions contained under these Terms of Use and binding policies hereof. By using the Platforms, You signify your acceptance of these Terms of Use, declare to have carefully read, understood and agree to be legally bound by them. If at any time, You do not agree or wish to be bound by these Terms of Use, You may not access and use the Platforms. As long as You comply with these Terms of Use, We grant You a personal, non-exclusive, non-transferable, limited privilege to enter, access and use the Platforms.

This document is an electronic record in terms of the Information Technology Act, 2000 and rules made thereunder and published in accordance with the provisions of Rule 3 of the Information Technology (Intermediaries guidelines) Rules, 2011. This electronic record is generated by a computer system and does not require any physical or digital signatures.

In addition to these Terms of Use, You may be required to comply with the terms and conditions of the third parties, whose links are contained/embedded in the Services. It is hereby clarified that Hardware 24x7 shall not be held liable for any transaction between the User and any such third parties.

ACCESSING, BROWSING OR OTHERWISE USING THE PLATFORMS INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS UNDER THESE TERMS OF USE, SO PLEASE READ THE TERMS OF USE CAREFULLY BEFORE PROCEEDING.

Products may be different than they appear on Application platform. Price are subject to change without any prior notice or information, It is Your responsibility to periodically review these Price for any update and changes.

REGISTRATION

Registration. In order to avail the Services or certain features on the Platforms You are required to register and set up an account on the Platforms (“Account”). Registration is a one-time process and is free of cost. You may register and create an Account in one of the following ways:

By creating an Hardware 24x7 account: by providing the relevant information for the creation of Your Account on the Platforms. Following this, an account with an exclusive username and password (basis Your inputs) will be created by Hardware 24x7 for You, After acceptance and acknowledgement to the TERMS OF SERVICE, SHIPPING POLICY, PRIVACY POLICY, CANCELLATION, REFUND AND RETURN POLICY.

1) INTRODUCTION

The portal, www.Hardware24x7.com (“Website”) and the mobile application ‘Hardware 24x7’ (“App”) (collectively “Platforms”) is managed and operated by Potential Wholesale Hardware Private Limited (“Hardware 24x7” or “We”), a private limited company incorporated under the Companies Act, 2013 with its registered office located at B-237, Road No. 6D, VKI area Jaipur, Rajasthan 302013, India. Hardware 24x7 is inter alia engaged in the business of wholesale and retail trade in Home Building Product sector and sale of their allied and auxiliary products (“Products”), through brick and mortar stores and through its Platforms.

2) PURPOSE OF THIS DELIVERY POLICY

2.1. This delivery policy (“Delivery Policy''), together with the ‘Terms of Use’, describes Hardware 24x7’s policies and procedures towards delivery of Products purchased on the Platforms. Hardware 24x7 makes all commercially reasonable endeavors to ensure that the Products are delivered to Users in a timely fashion.

2.2. Users are required to peruse and understand the terms of this Delivery Policy. If You do not agree to the terms contained in this Delivery Policy, You are advised not to accept the Terms of Use and the Delivery Policy and may forthwith leave and stop using the Platforms. The terms contained in this Delivery Policy shall be accepted without modification and accordingly, You agree to be bound by the terms contained herein.

2.3. In case of any conflict and/or discrepancies in the terms as may be stated in the Delivery Policy and in the Terms of Use, the provision of the Delivery Policy shall prevail to the extent of such conflict and/or discrepancies.

3) TERMS OF DELIVERY

3.1. Hardware 24x7 partners with third party logistic service providers ("Logistic Partners") in order to effectuate delivery of Products to the User’s Preferred OR Pre mentioned (On Platforms) Transport service located only at VKI (Vishwakarma Industrial Area), Jaipur. Details of the shipments will be provided to the User upon the purchased Products being handed over to the transport by Hardware 24x7. The User will also be provided with a GR (Goods Receipt) provided by the transporter for the purchased Product on the order confirmation page. Hardware 24x7 may also effectuate delivery of the Products to Transport service located only at VKI ( Vishwakarma Industrial Area) Jaipur on its own without engaging Logistic Partners.

3.2. While Hardware 24x7 aims to provide its services through the Platforms and ensure the delivery of its Products all across India, currently, Hardware 24x7 has a select list of areas where delivery can be undertaken. At the time of placing an order for purchase of Products on the Platforms, Users are required to enter their pin-code details to verify if deliveries can be carried out in their areas. If the area where the User wishes that the purchased Products be delivered is not within Hardware 24x7’s recognized delivery network, Hardware 24x7 will not be able to process the order further.

3.3. Prior to making payments on the Platforms for the purchase of Products, the User will be prompted to provide a shipping address. While entering shipping address details, the User should ensure to provide correct, complete and accurate information along with sufficient landmarks in order to aid identification of the address. Hardware 24x7 shall not be held liable at any point in time for any failure or delay in delivering the purchased Products arising out of the User’s failure to provide correct, complete and accurate information. Hardware 24x7 shall not be able to change the delivery address of the order once it has been placed and taken for execution.

3.4. While Hardware 24x7 shall make reasonable endeavors in ensuring that purchased Products are delivered to its Users in a timely manner, delivery may be delayed on account of:

logistical issues beyond Hardware 24x7’s control;

unsuitable weather conditions;

political disruptions, strikes, employee-lockouts, etc.;

acts of god such as floods, earthquakes, etc.; and

government / local body imposed lockdowns;

outbreak of a pandemic / epidemic; and

other unforeseen circumstances.

In such events of delay, Hardware 24x7 may, but shall not be obligated to, make reasonable attempts at proactively intimating the User by writing to the User on his/her registered email account and/or mobile number. Hardware 24x7 disclaims all liabilities that may arise on account of its failure to intimate the User of anticipated delays in the delivery of purchased Products on the Platforms. Further, Hardware 24x7 shall be under no obligation to compensate the User for any mental agony or any tortuous claim that may otherwise arise on account of a delay in the shipment and delivery or use of the purchased Products to the transport service located only at VKI(Vishwakarma Industrial Area), Jaipur. Hardware 24x7 disclaims all liabilities that may arise on account of user unavailable to receive the products purchased, Hardware 24x7 reserves the right for NO REFUND, RETURN, CANCELLATION OF the order. Further, Hardware 24x7 shall be under no obligation to compensate the User for any mental agony or any tortuous claim that may otherwise arise on account of user unavailable to receive the products purchased.

3.5. Hardware 24x7, as an internal process, undertakes multiple diligence to ensure that their delivery executives and the individuals employed by their Logistic Partners are individuals with the highest regard for ethics and integrity. However, it is not possible for Hardware 24x7 to ensure that its own delivery executives or employees of its Logistic Partners behave in a fashion that exudes thorough professionalism, competence and good mannerism. It is expressly clarified that any ill-mannerism, impoliteness, discourtesy or offensiveness shown by Hardware 24x7’s delivery executives or by the employees of the Logistic Partners is beyond Hardware 24x7’s control and any issue arising between a User and Hardware 24x7’s delivery executive or an employee of the Logistic Provider will have to be resolved by the User, independently.

3.6. Upon the successful placing of an order on the Platforms and after Hardware 24x7 has successfully handed over the purchased Product(s) to user’s selected transport service, the User will receive a unique GR (Goods Receipt) number, which will enable the User in tracking the status of delivery of the purchased Products. The User may use the tracking identity number on the mobile application of the Logistic Partner to check the whereabouts of the purchased Product and the estimated time of its delivery. However, Hardware 24x7 does not guarantee the accuracy of the tracking status since it is updated on a real-time basis and is subject to inconsistencies arising out of time-lags in updating the information and other technicalities beyond Hardware 24x7’s control.

3.7. Hardware 24x7 reserves the right to charge shipping charges on Products sold on its platform, the payment for which is made by way of pay on delivery or any other online mode of payment. If charged, such charges shall not be refunded to the User on cancellations or returns that are made after the shipping of the purchased Products, except in case of a Product having a defect at the time of handing over to user’s selected transport service (for reasons attributable to and accepted by Hardware 24x7 after due verification at its sole discretion). Title and risk of loss for all purchased Products shall pass onto the User upon the delivery of the purchased Products to the User OR to the User’s selected transport.

3.8. Return and exchange of purchased Products have been set out under the Return and Refund Policy. The returns and refunds can only be processed after the order delivery has been completed and the amount paid to the delivery agent.

CANCELLATION, REFUND AND RETURN POLICY

The portal, www.Hardware 24x7.com(“Website”) and the mobile application ‘Hardware 24x7’ (“App”) (collectively “Platforms”) is managed and operated by Potential Wholesale Hardware Private Limited (“Hardware 24x7” or “We”), a private limited company incorporated under the Companies Act, 2013 with its registered office located at B-237, Road No. 6D, VKI area Jaipur, Rajasthan 302013, India. The Hardware 24x7 is inter alia engaged in the business of wholesale and retail trade in Home Building Product sector and sale of their allied and auxiliary products (“Products”), through brick and mortar stores and through its Platforms.

 2) OBJECTIVES OF THIS POLICY

2.1 In keeping with Hardware 24x7’s goal of ensuring User satisfaction, this cancellation, return and refund policy (“Cancellation, Return and Refund Policy”), together with the terms of use at www.Hardware 24x7.com, sets out Hardware 24x7’s procedures and policies in accepting: (a) Product cancellations before the order is confirmed; or (b) Product returns, once a Product has been delivered to a User after purchase from the Platforms. Any return or cancellation of Products by Users shall be governed by and subject to the terms and conditions set out under this Cancellation, Return and Refund Policy.

2.2. Users are required to peruse and understand the terms of this Cancellation, Return and Refund Policy. If You do not agree to the terms contained in this Cancellation, Return and Refund Policy, You are advised not to accept the terms of service and may forthwith leave and stop using the Platforms. The terms contained in this Cancellation, Return and Refund Policy shall be accepted without modification and You agree to be bound by the terms contained herein by initiating a request for purchase of Product(s) on the Platforms.

3) Terms of cancellation

3.1. Cancellation before Order Confirmation.

3.1.1 A User is permitted to fully or partially cancel orders prior to Order Confirmation  from Hardware 24x7.

3.1.2 The user will be given a unique order ID which can be used by him/her to track the status of the order.

3.1.3 Prior to the invoicing of the purchased Products, should the User decide to cancel the purchase, the User can do so through App/website in the Order section.

3.1.4 Refund. In all events of cancellation, prior to the Order Confirmation of the purchased Products, Hardware 24x7 shall initiate refunds within 7(seven) business days from the date on which it received the request from the User.

3.1.5 In case of payment made through prepaid mode through any channel, the refund will be made to the original mode of payment and/or to User’s Hardware 24x7 wallet. All refunds shall be subject to applicable charges as may be deducted by the User’s bank.

3.2. There will be no Cancellation or Refund after dispatch. 

4) TERMS OF RETURN AND REFUND

For returnable products only, returns to be initiated within 3 days from the date of delivery of products, subject to the other terms and conditions of this Cancellation, Return and Refund Policy. Do read all sections carefully to understand the conditions and cases under which returns will be accepted and check the Products display page for Product specific return information. (subject to Para 4.7, please keep the item in its original condition, with outer box or case, user manual, warranty cards, and other accompaniments in manufacturer packaging for a successful return)

4.1. Notwithstanding anything to the contrary, Users cannot return certain Products which are specified as ‘non-returnable’ on the relevant Product pages of the Platforms, and (b) Such Products may be returned only in case of defects or damages in the Products, incorrect products shipped to the User, missing components and not for any other reason.

4.2 The User can only return Non-returnable Products if there are defects and deficiencies in the Product (attributable to, and accepted by Hardware 24x7 after due verification at its sole discretion) or if such Non-returnable Products are delivered late at user’s transport (except in case of force majeure including COVID-19). The User shall contact us by raising a Support Ticket to initiate a request for returning such Non-returnable Products not later than 72 hours or (three) days from the date of delivery of Product.

4.3. Subject to the terms of this Cancellation, Return and Refund Policy, Hardware 24x7 offers Users an easy return/refund policy. Hardware 24x7 also accepts damage returns wherein Users can raise a return request for one or all Products except in case of Bundled Packages (as defined hereinafter). The process for initiating the process for raising a return/refund/exchange request is:

Select the Support Ticket and click on “New Ticket” and follow the instructions on this page to obtain a Return ID.

At the time of creation of this return / refund request, the user will be prompted to enter the customer’s bank and account details. This will be used to refund the payment

The Products needs to be delivered at B-237, Road No. 6D, VKI area Jaipur, Rajasthan 302013, India at user’s responsibility.

Hardware 24x7 will initiate the refund process only if the Products are received in accordance with the Cancellation, Return and Refund Policy.

On certain select days as specified by Hardware 24x7, separate policies may be applicable.

4.4. While raising a request for return on the Platforms, the User shall have the option to seek a refund of the monies paid by him/her towards the purchase of the Product. The User may be required to produce a copy of the original invoice at the time of placing a request for return of Products. The User shall ensure that the Product(s) being returned comply with the conditions set out under this Cancellation, Return and Refund Policy and are, among other conditions, unused with no damage and stains, with price label intact, all packaging material undamaged and unused. Hardware 24x7 reserves the right to alter and enforce this Cancellation, Return and Refund Policy at any time without having to serve a prior notice on the User. However, Hardware 24x7 will notify the Users of any change in the Cancellation, Return and Refund Policy by posting a notice on the homepage of the Platform.

4.5. If a User has purchased Products which form a part of a package of other Products, or if the Product forms a part of a promotional package (collectively, the “Bundled Package”), the User shall be required to return all the Products that form a part of the Bundled Package for Hardware 24x7 to process refunds

4.6. Return of or refund for purchased Products shall not be entertained by Hardware 24x7 if:

the Product has been used, Hardware 24x7 shall reserve the right to reject the return of the Product;

the price tags, brand tags, box, original packaging material, and accompanying accessories have been damaged or discarded by the User;

the serial number / barcode of the Product, as applicable, does not match Hardware 24x7’s records;

the accessories delivered with the Product (such as user manuals, etc) are not returned along with the Product, in an undamaged condition;

there are any dents, scratches, tears or any other damage to the Products or any part thereof;

the gifts accompanying the purchased Product have not been returned, or upon being returned, show signs of being used, washed, or defect;

Hardware 24x7 is satisfied that the Product has been rendered defective or unusable; or

if the User in any way breaches the Cancellation, Return and Refund Policy

4.7. In the event a User returns a Product that is not accompanied by the accessories or other items originally bundled with such Product, Hardware 24x7 shall have the right, exercisable at its sole discretion, to (i) (a) refuse to accept the return of such Product, or (b) process any refund thereof, or (ii) deduct the amount payable in respect of such items from the amount of refund such User is entitled to.

4.8. Hardware 24x7 shall initiate a process of refund of the monies paid by the User towards purchase of a Product, if upon conducting quality checks, it is satisfied that the Product being returned entitles the User to a refund. It is further clarified that Hardware 24x7 shall not be required to make any refund or return the Product that it deems ineligible for a refund or return based on such quality checks.

4.9. It is expressly clarified that the refund entitled to by a User shall not include monies paid towards shipping charges or any other such charges.  

4.10. Refund amount will be credited to the customer's account within 2 to 7 working days from the material received in the warehouse. Hardware 24x7 shall make all reasonable attempts to keep the User apprised of the status of refund through updates shared on the User’s registered mobile number and email address. Hardware 24x7 disclaims all liabilities that may arise on account of its failure to keep the User apprised of the status of the refund.

4.11. If the request for refund is undisputed by Hardware 24x7, the refund should reflect in the User’s bank account and/or the User’s Hardware 24x7 Wallet within such reasonable time (subject to the policies of the User’s bank in case of bank account/credit card refunds) from the date on which Hardware 24x7 initiates the refund.

4.12. The refund will be made to the original mode of payment and/or to User’s Hardware 24x7 wallet.

4.13. Where a User has opted for pay on delivery option for payment towards the purchased Products, Hardware 24x7 shall process all refunds into either the User’s Hardware 24x7 Wallet or the Users’ valid bank accounts, if details of such accounts are provided by the User to Hardware 24x7 at the time of refund. Further, should the User have used more than 1 (one) payment option for the purchase of Products on the Platforms, Hardware 24x7 shall process all refunds through a Payment Option (as defined in the Fees and Payments Policy) Hardware 24x7 deems fit, in its sole discretion, to process such refunds. Once the amount is refunded into a User’s Hardware 24x7 Wallet, on request, it can be further transferred to a bank account as per details shared or would continue to remain in the User’s Hardware 24x7 Wallet until refunded/exhausted for shopping on the Platforms.

4.14. Return of purchased Products are facilitated by the User required to self-ship the Product to Hardware 24x7’s shipping warehouse, the address for which will be intimated to the User upon the User placing such request for return. Upon self-shipping the Product to Hardware 24x7’s warehouse, the User shall be required to scan the courier/postal receipt to contact@Hardware 24x7.in  for Hardware 24x7’s records. The aforesaid return by self-shipping the Products is subject to the returned Products passing quality check at Hardware 24x7’s returns desk/warehouse as provided in paragraph

4.15. In the event where the User claims to have self-shipped the Product in accordance with the process set out in paragraph [4.14] above and Hardware 24x7 does not receive the returned Product or the package containing such Product is empty, the User shall be required to submit the ‘proof of delivery’ received from the courier/postal agency to Hardware 24x7 to prove his/her claim of return of Products through self-shipment to Hardware 24x7. It is specifically clarified that any refunds shall be processed by Hardware 24x7 only upon receiving the returned Products and concluding required quality checks as provided in paragraph [4.7] or receiving the ‘proof of delivery’ from the User, as the case may be.

Privacy Policy

Potential Wholesale Hardware Private Limited is a company incorporated under the Companies Act, 2013 and having its registered office at B-237, Road No. 6D, VKI area Jaipur, Rajasthan 302013, India (“Hardware 24x7” or “WE”). The Hardware 24x7 is inter alia engaged in the business of wholesale and retail trade in Home Building Product sector and sale of their allied and auxiliary products (“Products”), through brick and mortar stores and through its Platforms.

 The Company values the trust placed in it by its Users and the privacy of the Users is important to the Company. This privacy policy (the “Privacy Policy”) together with the terms of use describes how the Company collects, uses and discloses the information provided by the Users of the Platforms. The Company shall not use the User’s information in any manner except as provided under this Privacy Policy. Every User who accesses or uses the Platforms shall be bound by this Privacy Policy. This Privacy Policy sets out the type of information collected from the Users, including the nature of the sensitive personal data or information, the purpose, means and modes of usage of such information and how and to whom the Company shall disclose such information.

This Privacy Policy is published pursuant to Section 43A of the Information Technology Act, 2000, Regulation 4 of the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 and Regulation 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.

Please read the Privacy Policy in totality to learn about the information gathering and dissemination practices of the Company. Every User who accesses or uses the Platforms shall be bound by this Privacy Policy

The Company reserves the right to update this Privacy Policy at any time, with or without any notice. The Company shall not be required to notify the Users of any changes made to this Privacy Policy. It is the responsibility of the Users to review the terms of this Privacy Policy periodically.

By mere access or use of the Platforms, the User expressly consent to our use and disclosure of the User’s personal information in accordance with this Privacy Policy. This Privacy Policy is incorporated into and subject to the Terms and Conditions. While the Users may be able to browse certain sections of the Platforms without registration, however, please note that the Company does not offer any product/Services under the Platforms outside India.

In general, A User is required to provide Personal Information when such a User chooses to avail or sign up for any of the services or create an account. Where possible, we indicate which fields are required and which fields are optional. All the information provided to the Company by a User, including Personal Information and personally identifiable information, is voluntary.

The User always has the option to not provide information by choosing not to use service or feature on the Platforms. It is the User’s duty to ensure strict caution while giving out any personally identifiable information about himself/herself/itself or his/her family members in use of any of the Services.

When the User access or uses the Platforms, the Company collects and stores the personal information of the User which is provided by the User from time to time during the course of its use or access of Platforms. The purpose of doing so is to improve the Platforms experience and services offered and to provide the Users with a safe, efficient, smooth and customized experience. The Privacy Policy applies to information collected and processed by the Company including, but not limiting to, the following:

Personal information is information related to a visitor, or a combination of pieces of information that could reasonably allow him to be identified. Personal information may consist of full name, personal contact numbers, residential address, email address, gender or date of birth. While information such as date of birth in isolation may not be enough to uniquely identify the visitor, a combination of full name and date of birth may be sufficient to do so.

Sensitive personal data or information is such personal information that is collected, received, stored, transmitted or processed by the Company, consisting of:

Password;

Financial information such as bank account or credit card or debit card or other payment instrument details; Physical, physiological and mental health condition;

Sexual orientation;

Medical records and history;

Biometric information;

Any detail relating to the above personal information categories as provided to the Company for providing service; and

Any of the information received under above personal information categories by the Company for processing, stored or processed under lawful contract or otherwise.

Please note that any information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law for the time being in force shall not be regarded as sensitive personal information.

Users can modify and correct the data about him/her/it which has been collected pursuant to his/her/it’s decision to become a User. Any grievances in relation to the information shared by the User with the Company may be brought to the attention of the grievance officer mentioned herein.

For the use of the Services and purchase of products, you may be required to pay the Company with a credit card, wire-transfer, debit card, or by any other mode through the Company’s third party payment gateway provider and such third party payment gateway provider may be required to collect certain financial information from you including, but not restricted to, your credit/debit card number or your bank account details (collectively referred to as “Financial Information”). All Financial Information collected from the Users’ by the Company’s third party payment gateway providers will be used only for billing and payment processes. The verification of the Financial Information shall be accomplished only by the User through a process of authentication in which the Company shall have no role to play.

The Financial Information collected from the Users is transacted through secure digital platforms of approved payment gateways which are under encryption, thereby complying with reasonably expected technology standards. While the Company shall make reasonable endeavors to ensure that the User’s personal information and the Financial Information is duly protected by undertaking security measures prescribed under applicable laws, the User is strongly advised to exercise discretion while providing personal information or Financial Information while using the Services given that the Internet is susceptible to security breaches.

The Company may also request you to provide your PAN, GST Number, Government issued ID cards/number and Know-Your-Customer (KYC) details to: (i) check your eligibility for certain products and Services including but not limited to credit and payment products; (ii) issue GST invoice for the products and Services purchased for your business requirements; (iii) enhance your experience on the Platforms and provide you access to the products and Services being offered by the Company.

The Platforms use temporary cookies to store certain data. The Company does not store personally identifiable information in the cookies. Information collected by the Company, by any means whatsoever, that does not personally identify the User as an individual (such as patterns of utilization described above) is exclusively owned by the Company and may be used by the Company and third party service providers for technical administration of the Platforms, user administration, research, development, and other purposes. This information is used solely to analyses overall User trends and to help the Company in improving its Services. Please note that the link between the User’s IP address and the User’s personally identifiable information is not shared with third parties without such User’s permission or except when required by law or to provide or facilitate the User with the Services. enabling Users to enjoy the services including but not limited to receiving messages through Short Message Service (SMS), WhatsApp messages and such other medium of communications; or enabling Users to enjoy the Services, to use the Products, including sharing information with Other Parties to provide services, technical support etc. in relation to the Products or Services; or detecting and preventing identity theft, fraud or any other potentially illegal acts; or monitoring and enhancing User interest and engagement, including through promotional activity, personal messages to Users using personally identifiable information provided by Users, etc. or processing the purchase of Products on the Platforms.

To the extent that other Parties have access to the personal information, the Company shall make efforts to ensure that the Other Parties treat such personal information at least as protective as they treat personally identifiable information obtained from their users or members.

The Company or the Other Parties may merge with or be acquired by another business entity. In such an event, the Company and the Other Parties may be required to transfer the personal information to such merging or acquiring party, as the case may be. While sharing such personal information with the acquiring or merging entity, as the case may be, the Company and the Other Parties shall make reasonable endeavors to ensure that the User’s personal information is duly protected by the acquiring or merging entity, as the case may be, by undertaking security measures prescribed under applicable laws.

The Company may also disclose or transfer the personal and other information provided by Users, to any third party as a part of reorganization or a sale of the assets, division or transfer of a part or whole of the company.
